I have had an ongoing dental malpractice suit…started lawsuit 3 years ago….it’s finally settlement time…incite etc.

By now did deposition ect.  So lets say I win…which i hope….how long would it take for me to recieve the settlement money?

Is the toughest part of waiting over?

Am I finally seeing a set alight at the end of the tunnel?

We had a incite day set for June but my attorneys assistant told me next week is some emergancy incite hearing settlement thing.

I’m so confused :(

    Question your attorney.

But, I assume that the June date was a trial date.

It is likely the incite has ordered a pre-trial settlement discussion. Next week your attorney and you, and the defense attorney and claims adjuster will grow before a judge. The judge will attempt to force settlement.

If you reach a settlement, once the adjuster gets the signed release and the stipulation of dismissal, then you will get your check. Most states have laws requiring the insurance company come forth payment within a certain time frame, like 20 days. Trust me, the adjuster wants to see this matter resolved just as much as you do.

If you do not settle, the case may go to trial in June. But, if it is not a date certain trial date it could be pushed back several times before you actual have a trial.
